1.1 Contractual Validity
A contract between the customer and Phoenix Parkservice is only concluded once the customer has accepted the General Terms and Conditions of Phoenix Parkservice and received a written confirmation from Phoenix Parkservice. The validity of this confirmation remains unaffected even if it is redirected or rejected due to spam filters or other technical obstacles in the customer’s email inbox.
1.2 Booking and acceptance of terms and conditions
By booking our service through one of the following contact methods, the customer unconditionally agrees to our contractual terms and conditions:

4.By using WhatsApp or SMS through our official contact number
For booking our services, customers are required to use our official contact methods, especially our website and email. Other contact methods are neither desired nor requested; however, the customer’s use of these contact methods for booking also implies acceptance of our terms and conditions.
The legal validity of the contract between Phoenix Parkservice and the customer comes into effect once the customer has expressed consent to the General Terms and Conditions of Phoenix Parkservice.
During vehicle collection and return, the customer is also obliged to confirm the handover protocol provided by us, either in printed or digital format, with a signature. Through this signature, the customer reaffirms their awareness of an agreement to our General Terms and Conditions.

You are obliged to ensure that you are allowed to use the services of Phoenix Parkservice with your car, also with regard to the rights of third parties.
1.7.1 The presence of occupants, whether humans or animals, inside the parked vehicle is prohibited. Phoenix Parkservice is authorized to grant access to the vehicle to governmental authorities.
1.7.2 Deactivation of Dashcams:
a. Upon entering our parking premises, the customer is obligated to immediately and fully deactivate their dashcam. Similarly, in the case of valet services, our drivers will also deactivate the dashcam (if technically feasible and not already done). This is done to safeguard privacy and comply with data protection regulations.
b. Our parking premises are utilized by various parties, including other lessors and car dealers who conduct their business and may have walk-in customers. It is strictly prohibited to film or monitor individuals without their explicit written consent. Therefore, the use of recording devices on the premises is strictly prohibited.
c. The customer bears full responsibility for ensuring that their dashcam is properly deactivated upon entering our parking premises or handing over their vehicle for valet service. Any violations of these regulations may result in immediate denial of access to the parking premises or termination of our services.
d. The option of deactivating the dashcam by our drivers does not exempt the customer from their own obligation to deactivate it. Deactivation by our drivers is not guaranteed. Thus, the valet service assumes no liability for any legal consequences or breaches of data protection regulations arising from the improper use of the customer’s dashcam.
e. By utilizing our valet service, the customer expressly agrees to adhere to these regulations, deactivate their dashcam at all times, and assume full responsibility for the consequences of using dashcams.
2.1 Booking of these services, along with all associated services, is subject to the following General Terms and Conditions (GTC) of Phoenix Parkservice.
2.2 The customer is obligated to notify us by phone 45 minutes before their arrival at Frankfurt Airport. Adhering to this timeframe is crucial; otherwise, Phoenix Parkservice’s liability for consequences is waived. If the customer contacts us only upon or shortly before their terminal arrival, terminal parking fees, as well as costs for our staff’s rapid transportation, will be incurred and borne by the customer.
2.3 The customer is obliged to adhere to the meeting point designated by our personnel for our valet service. If the customer arrives at an incorrect or non-designated meeting point, additional costs such as parking fees will be borne by the customer. In this case, we are also not liable for any inconvenience or waiting times.
2.4 Should the customer unduly delay the driver at the terminal area due to excessive luggage, jammed seats, or other delays, the customer shall cover the parking ticket costs. The valet service disclaims responsibility for such delays attributable to the customer’s behavior or equipment.
2.5 The customer must inform us immediately by phone upon landing at Frankfurt Airport. Failure to do so eliminates any liability or refund responsibility of Phoenix Parkservice. Additionally, occasionally, our staff may need to temporarily park customer vehicles in public parking areas for preparation purposes. Through careful organization and preparation, we ensure timely availability of the vehicle and offer efficient service to the customer.
2.6 To ensure smooth operations among customers on a specific day, the valet service reserves the right to temporarily park our customers’ vehicles in public parking spaces during pickup and return. On particularly busy days, it might be necessary to make interim stops with the vehicle. Thus, the customer agrees to ensure smooth operations for all customers.
2.7 In exceptional cases and urgent circumstances, our staff undertakes to temporarily park vehicles in public parking areas to prevent theft or damage. However, Phoenix Parkservice is not liable for property damage, vandalism, or impacts caused by third parties.
2.8 The version of these terms and conditions in effect at the time of contract conclusion is binding. Any previous versions lose their validity upon the release of a new version. It is the customer’s responsibility to ensure they are always informed about the most current conditions.
2.9 Contrary or deviating general terms and conditions (GTC) are not recognized by Phoenix Parkservice unless expressly and in writing agreed upon by Phoenix Parkservice.
3.1 The customer agrees, upon entering into the contract, to pay all costs incurred to Phoenix Parkservice. This includes, but is not limited to, the following:
3.1.1 Change of Appointment / Rescheduling / Substitute Driver
A – In the event of non-compliance with the specified arrival date and a deviation of more than 2 hours, Phoenix Parkservice reserves the right to charge an additional fee of €19.99 incl. VAT to cover the costs of last-minute provision of additional staff. These claims apply to vehicle handovers on both the departure day and the return day. The customer has the right to prove that a lesser damage has occurred.
B – In the event of non-compliance with the specified arrival date and a deviation of more than 12 hours, Phoenix Parkservice reserves the right to charge an additional fee of €29.99 incl. VAT for circumstances related to coordination and schedule adjustments. We also charge a fee of €10.00 incl. VAT for each additional day the vehicle is parked. These claims apply to vehicle handovers on both the departure day and the return day. The customer has the right to prove that a lesser damage has occurred.
C – If the customer fails to adhere to the agreed appointment time and it consequently becomes necessary, due to delays or tardiness, to deploy a substitute driver (“stand-in”) because the regular drivers of Phoenix Parkservice are unavailable, off-duty, or otherwise occupied with existing customer assignments at that time, Phoenix Parkservice reserves the right to charge a stand-in surcharge for the urgent deployment of the substitute driver. The amount of this surcharge will be determined by Phoenix Parkservice based on the urgency of the deployment, the current operational workload, and the time of day, and will be communicated to the customer prior to the deployment. However, the stand-in surcharge shall not exceed a maximum amount of €29.00 incl. VAT per deployment.
The customer has the option to accept the stand-in surcharge or decline the use of the substitute driver. In the event of a refusal, Phoenix Parkservice shall be exempt from any liability for delays, inconveniences, costs, or claims for damages that may arise for the customer due to the missed appointment or the refusal to use the substitute driver.
D – These claims mentioned above apply to vehicle handovers on both the departure day and the return day. The customer has the right to prove that a lesser damage has occurred.
3.1.2 Service ouside business hours
A- Phoenix Parkservice generally does not conduct vehicle handovers outside regular business hours. Should there be delays, such as due to a flight delay, this absolves Phoenix Parkservice from any obligation to provide vehicle handover or telephone availability during closing times. Clients hereby accept these terms and expressly waive any claims against Phoenix Parkservice arising from such non-deliveries, including hotel costs, damages, or reimbursements.
B- If Phoenix Parkservice choose to perform a handover outside the established business hours at its discretion, a fee of €19.00 incl. VAT per commenced overtime hour will be immediately levied.
3.1.3 Night Surcharge
Valet Service: For pickups or returns of vehicles to and from Frankfurt Airport (Valet Service) taking place between 10:00 pm and 6:00 am, an additional fee of €39.00 incl. VAT, in accordance with the provisions of these Terms and Conditions, will be charged. This fee is to be paid upon arrival to the night shift driver.
Shuttle Service: For shuttle rides between 10:00 pm and 5:00 am, a night surcharge of €25.00 incl. VAT is applied. This fee is to be paid on the spot to the night shift driver.
3.1.4 24-Hours-Bookings
For bookings made within 24 hours prior to the arrival time, an additional one-time fee of €29.00 incl. VAT will be charged to cover the costs of short-term provision of additional staff. This fee should be settled on site against a receipt or by bank transfer at the latest by the time of return.
3.1.5 Special vehicles or vehicle dimensions
Unusual overall length, height, or width of the vehicle must be specified in writing at the time of booking and will be charged separately in accordance with the provisions of these terms. Phoenix Parkservice applies a surcharge of €3.00 incl. VAT for each commenced day. In addition, we charge the following fees:
XL vehicleswith a length of 5 meters or more are subject to a surcharge of €19.00 incl. VAT.
For XXL vehicles with a length of 8 meters or more (possibly with a trailer), a surcharge of €29.00 incl. VAT is applied.
3.1.6 Additional persons
Groups of up to 4 people are transported free of charge using our shuttle service. From the 5th person onwards, a surcharge of €10.00 incl. VAT per person is charged.
3.1.7 Key Retention
If the customer wishes to retain their car key and not hand it over to us, a surcharge of €10.00 incl. VAT is applied. This surcharge covers any potential circumstances arising from retaining the key.
3.1.8 Luggage surcharge
Within the scope of our shuttle service, each passenger is allowed to carry one piece of hand luggage and one large luggage item free of charge. For each additional piece of luggage, a surcharge of €10.00 incl. VAT will be applied.
3.2 If you made your booking through the platform of our contractual partners, all surcharges, such as night and 24-hour flat rates, are to be paid in cash on site as per the agreement.
3.3 We reserve the right to offer new surcharges and chargeable additional services on our websites which may not be listed at the time of publication of the latest version of our General Terms and Conditions.
3.4 Notwithstanding the prices stated in our General Terms and Conditions (GTC), only the prices and conditions published on our website at the time of booking or ordering are valid. Any deviations between the GTC and the information published online in favor of the prices shown on the website are binding. We endeavor to continuously update our GTC to ensure consistency with the information provided online; however, in the case of discrepancies between the GTC and the website, the prices specified online do apply.
3.5 All fees mentioned above, as well as the prices on the website, are to be understood as gross prices.
Phoenix Parkservice is entitled to exercise the statutory right of retention and the statutory lien for claims arising from the rental agreement on your vehicle and vehicle key. Therefore, Phoenix Parkservice may refuse or delay the release of the parked vehicle until the entire invoice amount, including surcharges (such as night fees and cleaning costs), has been fully settled by the time of return.
If the owner cannot be identified upon return, Phoenix Parkservice is authorized to realize the lien in accordance with legal provisions.
5.1 For claims based on damage caused by us, our legal representatives or vicarious agents, we are liable :
- in case of injury to life, body or health
- in the case of intent or gross negligence
- in case of warranty promises, if agreed, or if the scope of application of the product liability law is opened.
5.2 Disclaimer:
As far as Valet Service is not liable according to the mentioned points under 5.1, the liability of Phoenix Parkservice, its employees, freelancers, legal representatives and vicarious agents is limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
5.3 Additional liability provisions:
5.3.1 Phoenix Parkservice assumes no liability for damage caused by acts of courtesy; such as jump-starting or parking assistance by its employees and/or agents.
5.3.2 Phoenix Parkservice is not liable for any minor scratches, signs of use, minor paint damage, stone chips or small dents on the vehicles. These types of damage and signs of use may remain hidden to the driver and may not be visible in the pictures/videos due to dirt, suboptimal lighting conditions, reflective car colors or a tight time frame due to upcoming tasks at the handover location at the time of vehicle handover. If the customer reports damages to the vehicle upon return that they believe were not present beforehand, it is the customer’s responsibility to provide clear and conclusive evidence that the damage was caused by our company, one of our employees, or agents, and that the damage did not exist at the exact time of the vehicle handover at the agreed location. Without such clear evidence, Phoenix Parkservice and its employees, staff, or agents shall not assume any liability for the claimed damages.
5.3.3 Phoenix Parkservice is not liable for damages which are solely caused by natural events, force majeure, other Hirers or other third parties. This includes in particular hail, theft, road blocks or damage by third parties.
5.3.4 In the case of minor breaches of contract, Phoenix Parkservice shall not be liable if such breaches are due to slight negligence.
5.3.5 Phoenix Parkservice is not liable for valuables or objects left in the vehicle in general.
5.3.6 Phoenix Parkservice is liable for breaches of duty only in cases of intent or gross negligence, unless otherwise specified below. In cases of simple negligence, Phoenix Parkservice is only liable if there is an injury to life, body, or health (personal injury) or a breach of essential contractual obligations.
5.3.7 Phoenix Parkservice is not responsible for damages and defects caused by external employees. Furthermore, all damages that occur during the agreed cleaning and preparation by the car wash or preparation staff are also excluded from liability. In this context, the terms and conditions of the respective car wash or reconditioning team shall apply. When booking our interior or exterior cleaning service, our team will transport the vehicle to the car wash “Waschpark” located at Dr.-Max-Fremery-Straße 13, 65451 Kelsterbach. By making the booking, the customer also accepts the terms and conditions of this car wash operator in Kelsterbach, which can be viewed at: http://www.waschpark-kelsterbach.de/page3.html. Phoenix Parkservice assumes no liability for any scratches or damages that may occur as a result of using the car wash.
5.3.8 Claims for damages arising from intentional or gross negligence shall be forfeited if they are not asserted in writing within two months of the contractually agreed return. If the customer claims damages for non-performance, the period shall be one month.
5.3.9. The so-called strict liability under warranty pursuant to Section 536, Paragraph 1, Sentence 1, First Alternative of the German Civil Code (BGB) is excluded.
5.4 When returning the vehicle to the terminal, our staff will carry out a vehicle check together with the customer in the form of a tour. Likewise, each customer should make a vehicle check on the spot. Afterwards, the customer signs that he/she has comprehensively inspected his/her vehicle and has accepted both the visual and mechanical condition, and thus any claims for damages requested afterwards in relation to the same vehicle will be forfeited.
5.5 Should any damage to the vehicle be falsely or intentionally claimed, which can be proven to have existed before the vehicle was handed over to Phoenix Parkservice, we reserve the right to take legal action and assess an administration fee of 80,00€ including VAT.
5.6 The Customer is responsible for any damage caused intentionally or negligently to the property of Phoenix Park Service or third parties within the premises of Phoenix Park Service. This refers to damages caused by the Customer himself, his employees, deputies, family members or companions, as well as damages brought to the premises by the same.
5.7 It is the Customer’s responsibility to take all necessary measures to prevent damage and to preserve the property of Phoenix Park Service as well as that of third parties. Should any damage occur, it is the Customer’s duty to notify Phoenix Parkservice immediately and take all necessary steps to minimize the damage.
5.8 Phoenix Parkservice shall not be responsible for any damage caused by the actions or omissions of the Customer or the person(s) accompanying the Customer, whether intentional or due to negligence.
5.9 As a result of the high traffic density of a busy metropolis such as Frankfurt am Main, which is known for its significant traffic congestion and congestion, delays may occur. The customer understands that delays of up to 50 minutes are reasonable and accepts these without any legal claims for performance or compensation.
5.10 We are not liable for any fees incurred, waiting time or inconvenience caused by early or late flight arrivals. Nevertheless, we will use our best efforts to take reasonable measures in such cases to ensure the smooth operation of our services.
6.1 Phoenix Parkservice grants you the right to make modifications to your booking details, including the date of arrival, time of arrival, or flight numbers. All amendments or changes must be submitted exclusively via email to Booking@phoenixparkservice.de or info@phoenixparkservice.de
6.2 Changes on our part are made exclusively for bookings that have been made directly through our Phoenix Parkservice website. Bookings made through our cooperation partners must be processed via the respective partners’ portals. The cost provisions according to section 3. Fees, are not affected by this and apply in full to changes made through our partners
6.3 Phoenix Parkservice grants you the right to cancel a booked service. However, cancellations are only possible before the agreed start of the service and must be submitted exclusively by e-mail to Booking@phoenixparkservice.de or info@phoenixparkservice.de.
6.4 Cancellations of agreed services must be made in writing to be effective. Verbal cancellations will not be accepted.

6.8 In case of cancellation after the agreed start of the service, the fee of Phoenix Parkservice shall be 100% of the agreed fees.
6.9 In case of early return, the fees of the excess parking days cannot be paid or settled.
6.10 Cancellation of an upgrade to Covered Parking or VIP Pact, are not possible after the start of the service.
6.11 Cancellation of the booked preparation of the vehicle is possible only until 48 hours before the end of the agreed return at the latest.
6.12 Please note that cancellation does not include automatic refund. Refunds will be made in accordance with the applicable refund policy and may vary from case to case.
6.13 For all refunds, Phoenix Parkservice will use the same means of payment that you used in the original transaction, unless otherwise agreed with you. Refunds will be made within 14 business days.
6.14 Statutory rights of withdrawal and termination of the parties remain unaffected by the above provisions.
6.15 We reserve the right to make changes to the cancellation conditions in the event of extraordinary circumstances beyond our control. In such cases, we will inform you immediately of any changes.
These General Terms and Conditions were adopted by Phoenix Parkservice and are effective from 01.01.2023. They can be modified or updated by Phoenix Parkservice at any time. Changes or updates become effective as soon as they are published on our website or otherwise communicated. Customers are encouraged to regularly review the Terms and Conditions to stay informed about any changes.
8.1 All content, including texts, graphics, logos, images, designs, and other materials used on our websites or in other publications, including content we have published on platforms of our contractual partners, are copyrighted and the property of Phoenix Parkservice.
8.2 Without our explicit written permission, it is not permitted to copy, reproduce, modify, distribute, publish, download, display, or use the contents in any other manner. Any unauthorized use, duplication, or distribution of these contents by third parties on the internet is expressly prohibited and constitutes a clear violation of our copyrights.
8.3 We reserve the right to take legal action and seek damages against individuals or organizations that infringe upon our copyrights, either in whole or in part.
